Terms of sale
These Terms of Sale apply when you buy a Rubaris product from our website. By placing an order, you agree to these Terms of Sale, together with our Shipping, Returns, Warranty, Safety & Care and Privacy policies. Nothing in these terms excludes, restricts or modifies any consumer rights that cannot legally be excluded.

In these terms, “Rubaris”, “we”, “us” and “our” means the operator of the Rubaris store:
Orders
Placing an order is an offer to buy.
You must be 18 years or older (or the age of majority where you live) to place an order. By ordering, you confirm that you meet this requirement.
A contract is formed when we accept your order and send order confirmation, or when we otherwise begin processing your order.
We may decline, cancel or refund an order where:
- the item is unavailable;
- payment is declined or reversed;
- fraud, abuse or misuse is suspected;
- the buyer does not meet our age requirement;
- your delivery address is unavailable, restricted or incomplete;
- there is a clear pricing, product, shipping or availability error;
- we cannot lawfully or safely supply the product to your location;
- we are required to do so by law.
If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item unless we are legally entitled to withhold it.
Product information
We try to make product descriptions, specifications, images, pricing and availability accurate.
Product colours, appearance, scale, packaging, accessories and display may vary slightly because of screen settings, production batches, supplier updates, photography, lighting or image presentation.
Some images may be AI-assisted, edited, staged or illustrative. We do not knowingly use images to misrepresent material product features, inclusions, dimensions, materials, safety qualities or performance.
You should check the product specifications, inclusions, safety information and compatibility details before ordering.
If we discover a material product or pricing error after you order, we may contact you to confirm whether you want to continue with the corrected information or cancel for a refund.
Pricing and payment
Prices are shown in the currency displayed at checkout.
For the regions we serve, prices include import duties, and any applicable local taxes are shown at checkout — see our Shipping page.
Any optional paid shipping upgrades or additional charges will be shown before payment.
Payment is processed securely through our payment provider. We do not see or store your full card details.
You must provide accurate billing, contact and delivery information.
Shipping
Shipping is governed by our Shipping policy.
Delivery estimates are estimates unless we expressly state that a delivery date is guaranteed.
If we become aware that we cannot dispatch or deliver your order within the stated timeframe or a reasonable time, we will contact you with an update and the options available under applicable law. This may include continuing with the order, accepting a revised delivery estimate, cancelling the order, refund, replacement or another lawful solution.
You are responsible for providing accurate and complete delivery details.
Duties and taxes
Duties are included for US, UK, EU and AU orders — you shouldn't be asked to pay anything on delivery. If you are, contact us before paying.
Orders are sold as delivered duty paid: import duties are included in the price, and any applicable local taxes are shown at checkout.
If you already paid an unexpected import duty or tax charge, contact us with your order number and receipt so we can review it.
We are not responsible for charges caused by incorrect delivery information, refusal to provide required customs information, unlawful import attempts, customer-requested address changes, or charges unrelated to import duties and taxes.
Returns and refunds
Returns and refunds are governed by our Returns policy.
Change-of-mind returns are separate from your rights for faulty, damaged, unsafe, incorrect or misdescribed products.
Nothing in our Returns policy limits consumer rights that cannot legally be excluded.
Warranty
Warranty claims are governed by our Warranty policy.
Our voluntary warranty is in addition to your statutory rights.
Your statutory rights may continue after the voluntary warranty period ends.
Consumer guarantees and mandatory rights
Our goods come with guarantees that cannot be excluded under Australian Consumer Law.
You may also have mandatory consumer rights in your country or region, including rights under UK consumer law, EU consumer law, or other applicable consumer-protection laws.
Nothing in these terms limits rights that cannot legally be excluded.
If there is a conflict between these terms and mandatory consumer rights, the mandatory consumer rights apply.
Safety and intended use
Rubaris products are consumer wellness products. They are not medical devices and are not intended to diagnose, treat, cure, prevent, monitor or alleviate any disease, injury or medical condition.
You must read and follow all instructions, warnings and safety information before use — see our Safety & care guidance.
You must use the product only for its intended personal and household wellness purpose, unless we have expressly approved another use in writing.
You must not misuse, modify, disassemble, repair, resell as a medical device, or use the product for clinical, commercial treatment, rental, gym, studio or institutional purposes unless expressly approved by us in writing.
If you have a medical condition, are pregnant, take photosensitising medication, have light sensitivity, have an eye condition, have recently had surgery, have an implanted medical device, or are unsure whether the product is suitable for you, seek advice from a qualified healthcare professional before use.
Customer responsibilities
You are responsible for:
- providing accurate order and delivery details;
- reading product information before purchase;
- using the product safely and as instructed;
- checking the product before use;
- stopping use if the product appears damaged, unsafe or abnormal;
- contacting us promptly about faults, damage, delivery issues or safety concerns.
Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, loss of profit, loss of opportunity, loss of data, or loss caused by misuse of the product.
To the maximum extent permitted by law, our total combined liability to you arising out of or in connection with these terms or your order — whether in contract, tort (including negligence), statute or otherwise — is limited to the amount you paid us for the product or products giving rise to the claim.
Nothing in this section excludes, restricts or modifies any liability that cannot legally be excluded or limited — including liability under Australian Consumer Law or other applicable consumer-protection laws, liability for death or personal injury caused by our negligence, or liability for fraud.
Events outside our control
We are not responsible for delay or failure caused by events outside our reasonable control, including supplier delays, carrier delays, customs delays, natural disasters, strikes, war, pandemic, government action, cyber incidents, payment provider issues, platform outages or supply-chain disruption.
Where such an event affects your order, we will provide a solution required by applicable law.
Our website and its content
Content on our website — including product pages, guides, FAQs and imagery — is general information about our products and their personal wellness use. It is not medical advice, and it is not a substitute for advice from a qualified healthcare professional who knows your circumstances.
We provide website content in good faith, but we do not promise it is complete, current or error-free, and you should not rely on it as your only source of information for decisions about your health or suitability to use the product.
You must not misuse our website, including attempting unauthorised access, introducing malicious code, interfering with its operation, or harvesting content or personal information from it.
Nothing in this section limits rights that cannot legally be excluded, or what we say elsewhere about the accuracy of material product information.

We use third-party providers for ecommerce, checkout, payments, hosting, analytics, fulfilment, shipping, fraud prevention and customer support.

Changes to these terms
We may update these Terms of Sale from time to time.
The version that applies to your purchase is the version published at the time you place your order, unless a change is required by law.
If part of these terms cannot apply
If any part of these terms is found to be invalid, unlawful or unenforceable in any jurisdiction, that part is severed — or, where possible, read down to the minimum extent required — and the rest of these terms continues to apply.
Governing law
These Terms of Sale are governed by the laws of Queensland, Australia.
You and we may bring proceedings in the courts of Queensland, Australia. This jurisdiction is non-exclusive: if the law of your country or region gives you the right to bring or defend a claim in your local courts, nothing in these terms takes that right away.
This does not affect any mandatory consumer-protection rights you have in your country or region of residence.
